Eligibility and Legal Compliance

You must be at least eighteen (18) years old or the age of majority in your jurisdiction to use the Services.

We may require users to provide their date of birth and other information to verify eligibility. Users who fail age verification or provide inaccurate information may be restricted or removed from the Services.

By using the Services, you represent and warrant that:

• you meet all eligibility requirements
• you are using the Services only where it is legal to do so
• you will comply with all applicable laws and regulations

The availability of certain features, including real-money competitions, may vary based on your geographic location. We may restrict or disable access based on location, identity, or compliance requirements.

We may use IP-based location detection or similar methods to enforce geographic restrictions and compliance requirements.

You are solely responsible for determining whether your use of the Services is lawful in your jurisdiction.

Accounts

To access certain features, you must create an account and provide accurate, complete, and current information, including accurate date of birth for eligibility verification.

You agree:

• to maintain only one account unless expressly authorized
• not to share your account with any other person
• not to create accounts using false or misleading information
• to keep your login credentials secure and confidential

You are fully responsible for all activity under your account.

We reserve the right to verify your identity, age, location, and eligibility at any time. Failure to provide accurate information or complete verification may result in suspension or termination of your account.

We may restrict access to paid features unless age and eligibility have been successfully verified.

Identity Verification and Data Use

In connection with certain features, including withdrawals, fraud prevention, or legal compliance, we may require identity verification.

This may include:

• government-issued identification
• facial or liveness verification
• address verification
• device, IP, and location data

This includes verification of age and eligibility for participation in paid features.

By using the Services, you consent to such collection, use, and processing as described in our Privacy Policy.

Failure to complete verification may result in restricted access, delayed transactions, or account suspension.

Credits, Payments, and Transactions

All payments are processed through third-party providers such as Stripe.

Credits

Credits are virtual, limited-use license rights within Drift Battle.

Credits may be used to enter skill-based competitions where permitted by law.

Credits:

• are not cash
• have no independent monetary value
• cannot be transferred or sold
• are non-refundable except where required by law
• are not redeemable for cash and do not represent stored monetary value

We reserve the right to modify, revoke, or restrict credits at any time for fraud prevention, compliance, or operational reasons.

Payments

By making a purchase, you authorize the applicable payment provider to charge your payment method. You may only use payment methods that you are authorized to use. We may suspend or reverse transactions if we suspect fraud, abuse, or unauthorized activity.

Chargebacks

Improper or abusive chargebacks may result in:

• account suspension or termination
• forfeiture of credits or rewards
• restriction of future access

Real-Money Competitions

Drift Battle may offer skill-based competitions involving entry fees and prizes where legally permitted.

By participating, you acknowledge:

• outcomes are based on player skill and not on chance
• no winnings are guaranteed
• participation may be restricted based on location or eligibility
• we may review, delay, or void results to ensure fairness, compliance, and integrity

Users must meet all age and location eligibility requirements to participate in real-money competitions.

We reserve the right to restrict or cancel competitions, audit gameplay and results, and suspend access to real-money features at any time.

You are responsible for any taxes associated with winnings.

We reserve the right to verify user eligibility, including age and location, prior to or after participation and to void participation if requirements are not met.

Referrals, Promotions, and Rewards

We may offer referral programs, bonuses, or promotional incentives. These programs:

• may be modified or terminated at any time
• may be withheld or reversed in cases of suspected abuse
• may have eligibility requirements including identity verification and geographic restrictions, including age and geographic eligibility

Referral abuse, including fake accounts or self-referrals, may result in forfeiture of rewards and account termination.

Prohibited Conduct

You agree not to:

• violate any applicable law or regulation
• use the Services from restricted locations
• create multiple accounts without authorization
• use bots, scripts, automation tools, or unauthorized software
• use VPNs, emulators, or device spoofing tools to bypass restrictions
• exploit bugs, vulnerabilities, or unintended mechanics
• manipulate gameplay, matchmaking, or scoring systems
• intentionally lose or collude to transfer value between users
• engage in fraudulent payments or chargebacks
• impersonate another user or entity
• providing false information, including inaccurate date of birth or identity details
• reverse engineer or attempt to access source code
• interfere with security or compliance systems
• harass or abuse other users

Violations may result in immediate suspension, termination, forfeiture of credits, and legal action.

Service Availability and Technical Risks

The Services may be affected by outages, delays, device or network failures, software bugs, or interruptions in gameplay or scoring. We do not guarantee uninterrupted or error-free operation.

You assume all risk associated with your device, internet connection, and technical environment.

Termination and Account Actions

We may suspend, restrict, or terminate your account at any time, with or without notice, for any reason including violation of these Terms, including failure to meet age or eligibility requirements, suspected fraud or abuse, or legal or compliance requirements.

If your account is terminated for cause, we may forfeit credits, rewards, or balances, void transactions or participation, and restrict future access.

You may stop using the Services at any time.

Intellectual Property

All content, software, and materials within the Services are owned by Drift Battle or its licensors. You are granted a limited license to use the Services for personal use only. No ownership rights are transferred.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee:

• uninterrupted or error-free operation
• availability in any location
• accuracy of results
• any winnings or financial outcomes
• eligibility to participate in competitions or access paid features

To the maximum extent permitted by law, we disclaim all warranties, express or implied.

Limitation of Liability

To the maximum extent permitted by law, Drift Battle shall not be liable for indirect, incidental, or consequential damages, or loss of profits, winnings, data, or opportunities, or technical failures or service interruptions.

Our total liability shall not exceed the greater of:

• the amount you paid in the 90 days prior to the claim; or
• $100 USD

This limitation applies to all claims, including any losses related to participation in competitions or use of virtual credits.

Indemnification

You agree to indemnify and hold harmless Drift Battle and its affiliates from any claims, damages, or expenses arising from:

• your use of the Services
• your violation of these Terms
• your violation of applicable laws
• your actions or misconduct

Dispute Resolution

Informal Resolution

You agree to first contact us at support@driftbattle.com to attempt to resolve disputes informally.

Arbitration

Except where prohibited by law, disputes shall be resolved through binding individual arbitration.

Class Action Waiver

You agree to waive any right to participate in class actions or class-wide arbitration.

Governing Law

These Terms are governed by the laws of the State of California.

Venue

If arbitration is not enforceable, disputes shall be resolved in courts located in San Diego County, California.

Electronic Communications

You consent to receive communications from us electronically, including emails and in-app notifications.

Changes to Terms

We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance.
